§ 1. General provisions

  1. These Terms of Service (the "Terms") set out the rules for the electronic services provided by cod·etic — Bartłomiej Grochowski, a sole proprietorship registered in the Polish Central Registration and Information on Business (CEIDG), with registered address at ul. Chłopska 32, 87-152 Wybcz, Poland, Tax ID (NIP) 8792739965, REGON 522307823 (the "Provider" or "cod·etic").
  2. The Terms are issued under article 8(1)(1) of the Polish Act of 18 July 2002 on the Provision of Electronic Services.
  3. The Provider can be contacted at: [email protected].

§ 2. Definitions

  1. Website — the website available at https://codetic.eu together with all sub-pages.
  2. User — any individual, legal entity or organisational unit using the Website.
  3. Consumer — a User who is a natural person performing a legal act not directly related to their business or professional activity.
  4. Contact Form — the interactive form on the Website that allows the User to send a message to the Provider.
  5. Brief Form — the multi-step form on the Website used to submit a software development inquiry along with a project description.
  6. Service — an electronic service provided to the User through the Website.

§ 3. Scope of services

  1. The Provider offers the following Services on the Website free of charge:
    1. publication of informational and marketing content about the Provider's activity (articles, case studies, service descriptions),
    2. operation of the Contact Form,
    3. operation of the Brief Form,
    4. provision of an RSS feed (/feed.xml) with articles published on the Website.
  2. Software development services delivered under a separate engagement contract are out of scope of these Terms.

§ 4. Conditions of use

  1. Using the Website requires:
    1. an internet-connected device,
    2. a current web browser supporting HTML5, CSS3, JavaScript ES2020 and session cookies,
    3. an active email account (when using the Forms).
  2. The Provider is not liable for downtime or disruptions caused by force majeure, unlawful third-party actions, or incompatibility of the Website with the User's technical infrastructure.
  3. The User must not provide unlawful content, in particular content that infringes the rights of third parties, public morality or applicable law.

§ 5. Conclusion and termination of the contract

  1. The contract for the publication of informational content is concluded when the User accesses the Website and ends when the User leaves it.
  2. The contract for handling a submission via the Contact Form or the Brief Form is concluded upon valid submission of the form and ends when the Provider replies, or when the related correspondence is discontinued.
  3. A Consumer is entitled to withdraw from the contract within 14 days of its conclusion, without giving any reason, under article 27 of the Polish Act of 30 May 2014 on Consumer Rights. The withdrawal statement may be sent by email to the Provider.

§ 6. Complaints

  1. Complaints regarding Services should be sent to [email protected].
  2. The complaint should contain at least: User identification (name, email), description of the issue and the expected resolution.
  3. The Provider responds to complaints within 14 days of receipt, by email.
  4. A Consumer may use out-of-court dispute resolution mechanisms, including the EU ODR platform at https://ec.europa.eu/consumers/odr/.

§ 7. Liability

  1. The Provider exercises due care to keep the Website continuously available but does not guarantee uninterrupted availability and reserves the right to suspend the Website for maintenance, upgrades or to remediate incidents.
  2. The Provider is not liable for damages resulting from the User's use of the Website in breach of these Terms or applicable law.
  3. The above limitations of liability do not apply to Consumers to the extent that mandatory law grants them broader protection.

§ 8. Personal data

The processing of personal data is described in a separate document: Privacy Policy.

§ 9. Final provisions

  1. The Provider reserves the right to amend the Terms for valid reasons, in particular changes in the law, changes to the Services, or organisational changes. Users are notified by publishing the new version on the Website.
  2. Matters not regulated by the Terms are governed by Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services and the Consumer Rights Act.
  3. Disputes arising under the Terms are resolved by the court having jurisdiction over the Provider's seat. This does not apply to Consumers — in such case the jurisdiction is determined by the Polish Code of Civil Procedure.
  4. The Terms enter into force on 4 May 2026.
